Terms Of Use Policy











TNT Internet Express, Inc. accounts are for use by one person with one simultaneous login session at a time. Accounts may not be transferred to another person. Account sharing is prohibited. TNT Internet Express, Inc. reserves the right to collect applicable back charges on any account which has been used by more than one person.

Personal webspace may not be used for business purposes.  Service at TNT Internet Express, Inc. may not be resold without prior written approval.  TNT Internet Express, Inc. reserves the right to collect applicable back charges on any account which has been used in this manner.

TNT Internet Express, Inc. will not be responsible for training, assisting, or maintaining users software, websites, or computer.  Technical support will be available during posted, normal business hours.  Response to a support request may, at times, be conducted on a call-back basis.

Unlimited Dial-up Access refers to an Internet Industry standard of normal usage without any restrictions on when you establish your dial-up account connection. The term "normal usage" describes a practice where you, the customer, are physically at your computer actively using your account.   This does not imply a continuous, dedicated, or unrestricted access to the internet through your account. Any means that are used to keep your connection alive while you are not physicaly in front of your computer using it are prohibited.  This includes, but is not limited to, pinging the system with either your email or a keep-alive program, and may result in account termination as determined by TNT Internet Express, Inc. management.  "Normal usage" is considered to be 7 hours average usage or less per day, or approximately 200 hours or less per month.    Customers exceeding "normal usage" of 200 hours during a month will have their account temporarily disabled and will be contacted to discuss the issue.  If you need to be connected more than "normal usage" allows, you will need a  Dedicated Access Account which allows you to be connected 24 x 7.

In consideration for TNT Internet Express, Inc. providing access to the Internet and the provision of web pages, and other internet related services, the user acknowledges and agrees that:

1. Internet access and all other services provided to TNT Internet Express, Inc. users may only be used for lawful purposes only, and the transmission or storage of any information, data, or material in violation of any federal or state regulation or law (including, but not limited to, material protected by copyright, trade secrets, and information that is confidential as a matter of law) is strictly prohibited. The subscriber will not transmit or store any information, data, or material that is threatening, harassing, libelous, or obscene.

2. The user is responsible for and must provide all telephone and other equipment and services required to access TNT Internet Express, Inc.  The user is responsible for all bills relating to that equipment including long distance fees incurred while connected to our service.

3. The user will not attempt to interfere with or compromise the operation of the TNT Internet Express, Inc. network or any other network in whole or part, to interfere with any of the equipment compromising the system, or to access other accounts or restricted areas of the system or any other system. Retaliations against the user by other users on the Internet due to the TNT Internet Express, Inc. user violation of this service agreement will be considered interference with TNT Internet Express, Inc. operations. TNT Internet Express, Inc. reserves the right to collect damages caused by such compromise or interference.

4. E-mail is available for use as an internal electronic messaging system. TNT Internet Express, Inc. will use its best efforts to maintain, but does not guarantee, the privacy of e-mail, network use, and the contents of user directories.

5. E-mail messages sent via TNT Internet Express, Inc. and the Internet are private communications between the user and others, and TNT Internet Express, Inc. has neither the authority nor the responsibility to regulate their content. The views and comments expressed by TNT Internet Express, Inc. users are solely those of their authors and do not reflect any review, approval or endorsement by TNT Internet Express, Inc.; nevertheless, TNT Internet Express, Inc. will attempt to assist users who receive objectionable e-mail and who notify TNT Internet Express, Inc. Further, TNT Internet Express, Inc. reserves the right to close the account (without refund to user or liability to TNT Internet Express, Inc.) of any TNT Internet Express, Inc. user who has used their account to transmit, or participate in; harassing, threatening, illegal or otherwise objectionable materials. Objectionable materials include, but are not limited to: bulk unsolicited e-mail (spam), the transmission of chain letters, the conduct or promotion of gaming or lotteries, the conduct or promotion of illegal activities.

6. All data distributed on the Internet by the user shall remain the intellectual property of the user, and the user warrants that he or she has full ownership rights or appropriate licenses to the reports, documents, photographs, graphic images, audio files, video files and other data placed on the Internet by the user. The user acknowledges and agrees that he or she is solely responsible for any actions to protect ownership rights in said data and that TNT Internet Express, Inc. has no control over the individuals using the Internet and that TNT Internet Express, Inc. expressly does not warrant that any individuals make copies of the user's information as distributed.

7. Use of TNT Internet Express, Inc. services, including the storage of information, is at the user's sole risk. Neither TNT Internet Express, Inc. nor any of its information providers, licensers, employees, or agents warrant either the results to be obtained from the service or that TNT Internet Express, Inc. service will be uninterrupted or error free. TNT Internet Express, Inc.'s services are provided on an "as is" basis without warranties of any kind, either express or implied. Neither TNT Internet Express, Inc. nor anyone else involved in creating, producing, or delivering TNT Internet Express, Inc. services shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of TNT Internet Express, Inc., the inability to use TNT Internet Express, Inc., or any breach of any warranty. The provisions of this section will survive any termination of this agreement.

8. The user and, in the case of a minor, the user's guardian or parent, acknowledges that TNT Internet Express, Inc. provides full Internet access and that some material on the Internet may be considered offensive to the user and, in the case of a minor, the user's guardian or parent , agree that they are solely responsible for the information that can be obtained and viewed on the Internet. The user and, in the case of a minor , the user's guardian or parent, agree that TNT Internet Express, Inc. is not responsible for any materials on the Internet that are obtained through this service.

9. The user will indemnify TNT Internet Express, Inc. and hold it harmless against any and all loss, damage, cost and expense which TNT Internet Express, Inc. may occur or become liable for by reason of any and all claims or actions for libel, violation of privacy rights, plagiarism, copyright infringement, and any and all claims arising in connection with matter distributed pursuant to the terms and provisions of this agreement and any claims or suits resulting from the user's use of the service including, without limitation, the expense and cost of defending any and all such claims and actions, except where such claims result solely from the negligence of TNT Internet Express, Inc.'s failure to perform its obligations under this agreement. The provisions of this paragraph shall survive any termination of this agreement.

10. Payment of service charges is due immediately upon billing. Payments not received within 15 days are to be considered delinquent and may be subject to reasonable collection fees. Delinquent accounts are subject to termination without notice.

11. TNT Internet Express, Inc. may delete all data , files, or other information stored in the user's account if the user's account is terminated for any reason.

12. TNT Internet Express, Inc. may suspend service to the subscriber at any time, and for any reason, without notice. If a suspension is to last for more than 30 days, the user will be notified as to the reason. TNT Internet Express, Inc. may terminate service to the subscriber at any time, and without notice, for violation of this agreement. TNT Internet Express, Inc. will not be liable for any damages or harm to the user resulting from such termination.

13. A user-id may not be changed once the user account has been activated by TNT Internet Express, Inc. except in cases where the user is being threatened or harassed. Proof of threats and/or harassment will be required.

14. Refunds will only be provided if the subscriber terminates service because the subscriber is unable to establish a connection with the service within 30 days of initial signup. Service is provided in 1, 3, and 12 month increments, billed in accordance with the subscriber's service choice.  Because of the discounts given for 3 & 12 month contracts, no refunds will be given on these accounts for any reason other than the inability of the subscriber to establish a connection within the first 30 days of service. In any case, set-up fees are non-refundable.

15. By logging into their account the user thus accepts service from TNT Internet Express, Inc., and the user acknowledges and accepts the terms of this agreement.

16. Returned checks are subject to a $25.00 handling fee; in accordance with the laws of the state of North Carolina. You may also have to pay a reconnect fee.

17. TNT Internet Express, Inc. reserves the right to change/modify these policies ay any time.  It is the responsibility of the user to review these policies to keep up to date with changes/modifications to the policies.

18. This agreement shall be governed by and construed in accordance with the law of North Carolina. This agreement contains the full understanding of the parties with respect to the subject matter hereof. Any acknowledgment of a TNT Internet Express, Inc. subscription order or other memorandum to the user which adds to, the provisions of conduct between parties nor trade practice shall act to modify the provisions set forth in this agreement.
